Our Legal Services
Welcome to Linville Law, where our focus is on helping clients solve problems and establish strategic plans that meet their individual and unique needs. Practicing almost exclusively in the areas of Estate Planning, Elder Law, and Probate Administration, our team has the experience and expertise to help you in the following areas:
Charlotte, NC Crisis Planning Services
Services include Medicaid Crisis Planning, Adult Guardianships Proceedings, and Crisis Special Needs Planning for unexpected inheritances, legal awards, or other financial windfalls that would disrupt current SSI, Medicaid, or other government benefits. Anyone in need of these services knows first-hand they often involve mental health issues, dementia, family conflict, grief, and sadness. Spouses, children, and other family members are not only dealing with complex legal issues but are also expected to develop a care plan and evaluate assisted living or skilled-level care facilities. Judy Linville and Cindy Lynn, a licensed social worker and certified geriatric care manager, work together on all crisis cases to ensure the client’s legal, emotional, and care planning needs are addressed.
Advanced Estate and Wealth Preservation Planning Services
Services include Income and Estate Tax Planning, Gifting, Asset Protection Planning, Business Succession Planning, Charitable Planning, Medicaid Pre Planning, and Advanced Special Needs Planning for the long-term needs of a disabled child or loved one.
Estate Planning Services
Reasonably priced customized estate planning packages for those clients with modest estates and basic estate planning needs. The package includes a will that directs the distribution of property and names a guardian for minor children. It also includes the vital Financial and Health Care Powers of Attorneys needed to prevent a costly Court Supervised Guardianship proceeding in the unexpected event of disability or incapacity.
Trust Administration Services
Services include advising and assisting our clients who have been named or appointed as fiduciaries to administer the property or estate of another.
We help Executors qualify and administer estates pursuant to the decedent’s last will and testament.
We help Personal Representatives qualify and administer estates pursuant to the North Carolina intestacy laws when there is no will.
We help Trustees administer trusts.
We help clients who have been appointed the Guardian of the Estate of a minor or incompetent adult in the administration of the ward’s estate.
Judy and her staff work closely to make sure the fiduciary understands his or her role and completes the administration in accordance with all terms of any governing estate planning document(s) and in compliance with all state and federal laws. Common fiduciary duties and responsibilities include preparing and filing inventories and accountings with the courts and/or beneficiaries, filing and paying taxes, managing and investing trust or estate assets, paying creditors, and making distributions to beneficiaries.
